Terms of Service

1. Acceptance of Terms

Welcome to biddl (“biddl,” “we,” “us,” or “our”). By downloading, installing, accessing, or using the biddl mobile application and web companion (the “App”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and biddl. We reserve the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

biddl is a productivity tool designed for contractors, handymen, and service professionals. The App provides the following services:

  • Audio and video recording of job walkthroughs, site assessments, inspections, and other on-site evaluations
  • Automated speech-to-text transcription powered by Groq’s hosted Whisper model
  • AI-generated job estimates and analysis powered by Anthropic Claude, including scope-of-work summaries, material lists, cost breakdowns, receipt OCR, and project analysis reports
  • Job and project file management, organization, and search
  • PDF export, email delivery, and printing of generated documents

3. Eligibility

You must be at least 18 years of age to use the App. By using biddl, you represent and warrant that you are a licensed contractor, handyman, service professional, or otherwise authorized to perform the work you document and estimate through the App.

4. Account Registration

To use the App, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. biddl reserves the right to suspend or terminate accounts that contain inaccurate or incomplete information.

5. Subscription Plans & Payment

biddl offers a free tier with a limited number of AI-generated estimates per month and a Pro subscription plan with unlimited access to all AI features. Subscription fees are billed through Apple’s App Store and managed via RevenueCat.

  • Free Plan: Limited AI estimates per billing cycle. Core recording and job management features included.
  • Pro Plan: Unlimited AI estimates, priority processing, and all premium features. Billed monthly or annually.

All subscription purchases are subject to Apple’s terms and conditions. Refunds are handled exclusively through the App Store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws, rules, or regulations
  • Record job sites or conversations without proper consent as required by applicable federal, state, or local law (including one-party and two-party consent jurisdictions)
  • Upload, transmit, or process content that infringes any intellectual property, privacy, or other rights of a third party
  • Attempt to reverse engineer, decompile, or disassemble the App or its underlying AI models
  • Interfere with or disrupt the App’s infrastructure, servers, or connected networks
  • Share your account credentials or allow unauthorized access to your account

7. AI-Generated Content Disclaimer

biddl uses artificial intelligence to transcribe audio and generate job estimates and analysis reports. While we strive for accuracy, AI outputs are provided “as-is” and may contain errors, omissions, or inaccuracies.

AI-generated estimates and reports are intended as drafts and productivity aids only. They do not constitute certified professional assessments, guaranteed pricing, or binding contracts. You are solely responsible for reviewing, editing, and verifying all AI-generated content before presenting it to clients or using it in any professional context.

biddl is not a contracting company, does not provide construction or repair services, and does not establish a contractor-client relationship with any user.

8. Recording Consent & Compliance

You are solely responsible for obtaining all necessary consents before recording any job walkthrough, site assessment, client meeting, or inspection using the App. Recording laws vary by jurisdiction, and it is your obligation to comply with all applicable federal, state, local, and international laws governing audio and video recording.

biddl bears no liability for recordings made without proper consent or in violation of applicable law.

9. Intellectual Property

The App, including its design, code, AI models, interfaces, and branding, is the intellectual property of biddl and is protected by copyright, trademark, and other intellectual property laws.

You retain full ownership of your recordings, transcripts, job data, and any documents you create or generate using the App. By using the App, you grant biddl a limited, non-exclusive license to process your content solely for the purpose of providing the services described herein.

10. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. Please review the Privacy Policy carefully. By using the App, you consent to the data practices described in the Privacy Policy.

11. Confidentiality & Client Information

We understand that service professionals handle sensitive client information, including property details, project specifications, and pricing. biddl processes your data using encrypted connections and secure cloud infrastructure. However, you acknowledge that no electronic transmission or storage method is 100% secure.

It is your responsibility to assess whether the use of cloud-based AI tools is appropriate for the specific job and whether such use complies with your professional obligations regarding client confidentiality and applicable licensing requirements.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIDDL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

14. Indemnification

You agree to indemnify, defend, and hold harmless biddl, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) recordings made without proper consent.

15. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App settings.

Termination does not relieve you of any obligations incurred prior to termination, including payment obligations for active subscriptions.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the “Effective Date” above. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
